Bonneville County, Idaho State Court Records

Court records in Bonneville County, Idaho, are judicial documents generated to serve as an official account of legal proceedings held in the jurisdiction. Permanently filed with and maintained by the Clerk of the District Court (also the County Clerk, Auditor, and Recorder’s Office) in Bonneville County, these records aim to foster public trust in the judiciary, as well as to support the judiciary’s role and protect individual privacy rights and interests.

Court records, especially when analyzed alongside other public records, can offer deeper insight into a legal issue. For instance, comparing arrest and court records may clarify the sequence of events that culminated in a criminal case. Furthermore, a complete overview of an individual’s litigation history can be achieved by integrating local court records with federal case files, despite the latter being managed by a separate court system.

Are Bonneville County Court Records Public?

Yes. Idaho Court Administrative Rule 32 (ICAR 32) governs public access to court records in Bonneville County. Under this regulation, case information and documents maintained by courts in Bonneville are largely accessible to the public. Consequently, anyone can view or inspect these records, and restrictions are imposed only when a record has been made confidential by law, court rule, or court order.

Examples of publicly exempt court records in Bonneville County include

  • Juvenile delinquency and dependency records
  • Adoption files
  • Arrest and search warrants that have not yet been returned to the court, along with the associated affidavits or sworn testimony and records pertaining to their issuance
  • Pre-trial risk assessments and pre-sentence investigation reports, subject to exceptions provided in Idaho Criminal Rule 32
  • Records related to grand jury proceedings and the identities of the jurors, except as permitted by Idaho Criminal Rules or statutes

Other exceptions are outlined in ICAR 32(g).

What Information is Available in Bonneville County Court Records?

ICAR 32(d) lists categories of court case records that are generally available to the public through terminals that may be located at judicial branch facilities or online through case management systems maintained by the judiciary. These include

  • Litigant/party names
  • Chronological case summaries, also called the register of actions
  • Court calendars and dockets, including the date and time of hearings, the location of hearings, and the case numbers and captions
  • Transcripts and recordings of all open trials and hearings
  • Filed documents, such as pleadings, affidavits, motions, responses, memoranda, briefs, and other documents filed or lodged in a case file

Note: The above list includes both case information (summary data about a court proceeding) and case documents (the actual filings lodged in the case file). The precise contents of a court case file will vary based on the nature or complexity of the legal matter.

Fees for Court Records in Bonneville County

Members of the public have the right to freely inspect (view) Bonneville County court records, as stipulated by ICAR 32. However, while viewing is free, Idaho Code § 31-3201 permits the Bonneville County Clerk of the District Court, who is the sole custodian of these records, to charge reasonable fees to cover the cost of reproducing case documents:

  • $1 per page for plain copies
  • $1 per seal to certify a document
  • $10 per electronic or digital recording

Importantly, the Clerk of the District Court (or the County Clerk’s Office) does not manage vital records, such as birth, death, and divorce certificates. However, marriage licenses and the resulting marriage records are issued and obtained through the Clerk’s Office.

For official birth, death, and divorce certificates, as well as state-certified marriage records, these are available through the Idaho Department of Health & Welfare. One can contact this state department to verify current fees and processing times.

Criminal Records Access in Bonneville County

Criminal jurisdiction in Bonneville County, Idaho, is distributed between the district court and its magistrate division. The district court retains original jurisdiction over all criminal matters, primarily handling felony cases and appeals originating from the magistrate division. The magistrate division is delegated to handle misdemeanors and conduct preliminary hearings to determine probable cause for felony complaints.

Because all Bonneville County court records are centralized under a single elected official-the Clerk of the District Court-individuals seeking access to criminal records can inquire at this office, which simplifies the retrieval process. Criminal case access can also be sought through the iCourt portal.

Records released by the courts in Bonneville County, however, do not constitute a person’s comprehensive criminal record (RAP sheet). Such records can be obtained from the Idaho State Police’s Bureau of Criminal Identification (BCI), the state’s central repository of criminal history information.

Section 67-3008 of the Idaho Code permits public access to Idaho criminal history information, which captures arrests that did not result in charges and out-of-county convictions-information that standard Bonneville County court records searches do not typically reveal.

The BCI offers both name-based and fingerprint-based record checks for reported arrest data. However, accessing arrests with no disposition after 12 months from the arrest date is restricted; under Section 67-3008(2)(b), only the subject of the record, a criminal justice agency, or an individual with a signed release from the subject may request such a record.

Bonneville County Probate Records

Probate is a court proceeding initiated after a person’s demise to validate their will (if drafted), legally distribute their assets to beneficiaries or heirs, and settle outstanding liabilities to creditors. The Magistrate Division of the Bonneville County District Court hears these matters, serving as the county’s "probate court" and as the official custodian of probate records (sometimes called "estate records").

Bonneville County probate records are open to the public under ICAR 32. Consequently, any member of the public can search these records on the Idaho iCourt portal, complete and submit the clerk’s Court Public Records Request form via email, or visit the clerk’s physical office to access the records. Confidential information, such as a Social Security number or financial account number, is not disclosed to the general public to guard against identity theft or financial harm.

Note: Besides informal and formal estate proceedings (probate), the Magistrate Division of the Bonneville County District Court also hears special proceedings, such as adoption/termination of parental rights, Child Protective Act cases, and guardianships of minors or incapacitated persons. Although most probate records are public, legal protections for these filings are more stringent, and the resulting records generally remain closed to the public. For instance, the existence of a guardianship case is often made public, but the actual records in the court file, such as status reports, medical reports, and financial accountings, are shielded from public view.

Bonneville County Family Court Records

Bonneville County family court records originate from domestic relations cases handled by the Magistrate Division of the Bonneville County District Court. This division is responsible for hearing various domestic matters, including divorce, child support, child custody, and alimony. While the district court can also handle domestic cases like divorce and child custody, this typically occurs only when such matters are appealed from the magistrate division.

Public access to family court records in Bonneville is governed by ICAR 32 and the Idaho Rules of Family Law Procedure (IRFLP). Under these regulations, anyone may request to view or copy a family court record from the Clerk of the District Court or by accessing the Idaho iCourt portal. However, confidential data-such as parenting plans, financial statements, or minors’ identifying data-will not be disseminated unless the requesting party is a person authorized by law or judicial order.
